Court of Protection Forms

1. Accessing the Forms

Click here for All Court of Protection forms (COP forms).

They can be saved using the ‘save as’ button as a PDF document that can then be amended as required, printed or emailed securely.

2. Property and Affairs Applications

The following are the forms that need to be used;

  1. During an application regarding property and affairs; or
  2. During proceedings after an application has been issued.

This form should be completed by any person providing written evidence to support the application. It should be provided to the applicant who must submit it to the Court, either as part of the application or, if being provided during proceedings, before the next hearing and as agreed by the Court.
Proceedings about you in the Court of Protection COP14 After the Court has issued the application This form should be completed by the applicant and provided to the person who lacks (or may lack) capacity. It notifies them that proceedings have started at Court and the reasons for this. A verbal explanation should also be given as required to support the person to understand the content of the form. Form COP20A must be completed after issuing the COP14.
Certificate of notification/non-notification of the person to whom proceedings relate COP20A

After the Court has issued the application

This form should be completed by the applicant and submitted to the Court. It confirms that the person who lacks (or may lack) capacity has been notified of the application (or in certain circumstances, not been notified).
Notice that an application form has been issued COP15 After the Court has issued the application This form should be completed by the applicant and given to any person named in COP1 as either a party to the proceedings, or an interested party. They should also be given a blank COP5 form at the same time.
Acknowledgement of service/notification COP5 After the Court has issued the application A blank copy of COP5 should be provided to any person notified of the application through a COP15. It is for the person receiving the COP5 form to complete it and return it to the Court if they wish to do so.
Certificate of service/non-service/non-notification COP20B

This form should be completed by the applicant and submitted to the Court. It confirms whether or not each person named in the COP1 as a party to the proceedings, or as an interested party has been notified of the application (or in certain circumstances, not been notified).

3. Welfare Applications

The following are the forms that need to be used;

  1. During an application regarding welfare; or
  2. During proceedings after an application has been issued.

This form should be completed by the applicant and submitted to the Court. It confirms whether or not each person named in the COP1 as a party to the proceedings, or as an interested party has been notified of the application (or in certain circumstances, not been notified).

4. Deprivation of Liberty Applications

The following are the forms that need to be used during an application regarding the authorisation of a Deprivation of Liberty when the person who lacks capacity to consent to their care or treatment is;

  1. 16 or 17 years old; or
  2. Is 18 and receiving care or treatment in any environment that is not a care home or a hospital.
Need to Know
If the person lacking capacity is over the age of 18 and receiving care or treatment in a care home or a hospital the deprivation of their liberty cannot be authorised by the Court. In this case the Deprivation of Liberty Safeguards must be used.

During application This form should be completed by the applicant. It contains 3 Annexes (A, B and C), all of which must also be completed.
Assessment of capacity COP3 During application This form should be completed by the person who has assessed P’s capacity. It should be provided to the applicant who must submit it to the Court at the same time as COP DOL10.

There is a streamlined process for the Court to authorise deprivations of liberty without the need for an oral hearing, unless;

  1. P objects to any aspect of the application;
  2. P’s capacity, whether or not he is being deprived of his liberty or whether the deprivation is in his Best Interests is being contested by anyone; or
  3. The applicant has not taken reasonable steps to consult with P or any other parties it would be relevant to consult with;
  4. The Court is concerned with any of the information provided by the applicant;
  5. The Applicant has recommended a full hearing and the Court is in agreement;
  6. The Court identifies any other reason that an oral hearing would be appropriate.

If the Court decides that an oral hearing is required the following forms will also be required;

This form should be completed by the applicant and submitted to the Court. It confirms whether or not each person named in Annexe B of form COP DOLS10 has been notified of the application (or in certain circumstances, not been notified).

5. Other Forms

There are a range of other COP forms that;

  1. Only apply in specific circumstances; and
  2. Must only be completed by particular persons.

The table below sets out some of the forms that you may be asked to complete in your role as a representative of the organisation.

Annexe C-Supporting information COP1C During property and affairs applications regarding wills, codicils (similar to a will), deeds of variation (changes to a will), gifts or statement of property. This form should be completed by the applicant and submitted to the Court at the same time as COP1, along with any relevant supporting evidence.
Annexe D-Supporting information COP1D During property and affairs applications to appoint or discharge a trustee. This form should be completed by the applicant and submitted to the Court at the same time as COP1, along with any relevant supporting evidence.
Annexe E-Supporting information COP1E Whenever an application is being made to the Court by an existing Deputy of Donee of a LPA. This form should be completed by the Deputy or Donee making the application, and submitted at the same time as COP1.
Annexe F-Supporting information COP1F Whenever the validity or appropriateness of an existing Deputy of Donee of a LPA. This form should be completed by the person making the challenge, and submitted at the same time as COP1.
Deputy’s declaration COP4 Whenever a person is making an application to become a Deputy This form should be completed by the person wishing to become a Deputy, and submitted to the Court.
Application to object to the registration of a Lasting Power of Attorney COP7 Whenever an intended Donee of an LPA or a notified person is objecting to the LPA being registered. This form can only be completed by an intended Donee or a person who has received formal notification of someone’s intention to register an LPA.
Application notice COP9 Whenever a further order is being requested within existing proceedings. This form should be completed by the applicant and submitted to the Court.

6. Completing Forms

Knowing which forms to complete

Due to your familiarity with the case, and your role as the organisations representative you may be asked to complete a range of Court of Protection forms (COP forms) as;

  1. Part of an application to the Court; or
  2. During any part of proceedings. 

It is not your role to know which forms need to be completed and you should always be provided with appropriate legal support when completing forms.

Guidance on completing forms

This resource contains some basis guidance about completing COP1 and COP24, but before completing any form you should check whether any formal guidance exists. This will be found either;

  1. On the top or bottom of the form itself; or
  2. As a leaflet, accessed from the same page as the main list of forms.

If you are in any doubt about how to complete a form seek legal support as soon as possible, as most forms have a limited timeframe in which to be completed and submitted to the Court.

Pitfalls to remember when using the forms

There are a few pitfalls to be aware of when using the COP forms;

  1. The boxes do not expand to allow for additional text;
  2. There is no spell check facility , so you need to proof read forms before submitting them;
  3. You cannot copy and paste text into the forms;
  4. Any text that you input cannot be copied into other areas of the form; and
  5. You need to print the form out to sign it (no electronic signatures).
