1. Policy

All gifts presented to children and young people resident in the Home should be given on behalf of the Council. Staff should not give personal gifts to a child or young person, unless specific permission has been given by the Head of Children's Social Care under special circumstances. The receiving of gifts by staff is governed by the Council's Policy on Gifts and Hospitality (N1).


2. Key Points


2.1 Staff should be aware that the giving of personal gifts to children and young people, without special permission being given, could be misconstrued and could lead to allegations of misconduct.
2.2 When staff present children and young people with gifts, it should be made clear to the child/young person concerned, and their family, that they are presenting the gift on behalf of the Council.
2.3 The purchase of any gift presented to a child or young person should be accurately recorded in the Homes accounts, as well as on the child/young person's file.
2.4 Staff should familiarise themselves with the Council's policy on the receiving of gifts and hospitality, and should comply with this procedure if offered gifts or hospitality by a child or young person, or his or her family.


3. Gift Giving and Receiving Procedure

  1. Gifts and hospitality should not be accepted where it would lead any reasonable person to believe that you might be influenced by the gift or hospitality given or received.
  2. Any gifts or hospitality accepted, or refused, must be in accordance with the Council's Policy (N1) and must be recorded in the Home's records.
  3. All gifts given by staff to children and young people should clearly state that they are being presented on behalf of the Council.
  4. Any member of staff who wishes to give a personal gift to a child or young person must obtain prior agreement in writing from the Head of Children's Social Care.
  5. An up-to-date copy of the East Riding of Yorkshire Council's policy on Gifts and Hospitality (N1) should be available within the Home for staff to consult.
