Capacity and Consent In this chapter guidance is offered in relation to the various situations in which consent is likely to be sought, with reference to previous legal judgements. This is a potentially complex practice arena and if the practitioner is in any doubt about gaining consent they should always seek further advice from managers and legal advice must be sought as necessary.
Use of Social Media Sites by Social Care Staff

The use of social media in a social care and safeguarding environment is a developing area. Cases and reviews have discussed the use of social media in social work practice. There is, however, currently no specific government guidance on the issue. This chapter is designed to highlight some of the issues to be considered, with links to additional information. It is not intended to provide any legal advice, and legal advice must be sought as appropriate. Local Authorities and Courts may have local protocols in place on the use of social media/service of documents.

This chapter will continue to be updated as the body of case-law develops.
Storage of Data on Mobile Devices

This chapter provides guidance on the storage of personal data (including photographs) on mobile devices. 'Personal data' is any information about an identifiable living individual.

'Mobile devices' includes memory sticks, mobile telephones including smartphones, tablet technologies, netbooks and laptops.

Prevention of Homelessness and Provision of Accommodation for 16 and 17 year olds who may be Homeless and/or require Accommodation; and Duty to Refer Young people may become homeless for a variety of reasons. However, family breakdown, mental health concerns and unemployment are often major contributing factors to this. 16 and 17 year olds who are homeless or threatened with homelessness are likely to be vulnerable and will often be at risk of harm in the absence of intervention. Safeguarding and promoting their welfare should be central to service provision. Relinquished Children

The term 'relinquished child' is used to describe a child, usually a baby or at pre-birth stage, whose parents are making the choice of adoption for the child.

This chapter deals with the first stages of the adoption process for relinquished children, whilst signposting other key processes that should be progressed and which are expected for any child who is Accommodated or where the plan is for adoption. It also summarises the counselling and support that will be made available to the birth family in these circumstances. Once a decision is made and consent is formally given, although not irreversible, the adoption process is as for any other child.
Retention Schedule

As requested by the chair of the Independent Inquiry into Child Sexual Abuse destruction of case management and policy records relating to the following subject areas must not be implemented until the said inquiry has been completed:

  • Educational support;
  • Looked After Children;
  • Residential care;
  • Schools and schooling;
  • Services to children and families;

Assessments In Section 2, The Purpose of Assessment, it makes clear that when assessing the child it is important to analyse their needs and/or the nature and level of any risk and harm being suffered by the child including any factors that may indicate that the child is or has been trafficked or a victim of compulsory labour, servitude and slavery.
Access to Records The amendments make clear that The Data Protection Act applies to both paper and manual records and records held electronically. It is important that electronic recording systems comply with the requirements for children and their families to easily find their story in a logical narrative. In Section 7, Applications by Parents, the chapter makes clear that information about a child belongs to them and that parents do not have an automatic right of access to such information.

Families with No Recourse to Public Funds There has been a minor amendment to Section 2, Role of the Local Authority, where it has been clarified that when carrying out a Child in Need Assessment for all 'separated' children under the age of 18 and to provide them with services in line with needs identified under the Children Act 1989 the assessment must include:  any issues that may indicate that the child is or has been trafficked or a victim of compulsory labour, servitude and slavery.
Decision to Look After and Care Planning Section 1, Decision to Look After Child, has been substantially amended and expanded in light of: Re N (Children) (Adoption: Jurisdiction) [2015] EWCA Civ 1112 good practice the President of the Family Division, Sir James Munby sets out his view in respect of good practice in the recording of parental consent to a Section 20 agreement
Placements in Residential Care The chapter has been amended in order to ensure that all parties are clear about their responsibilities in commissioning and supporting residential placements e.g. in placement planning an understanding of the provider's therapeutic approach should inform the child's Placement Plan.
Placements with Connected Persons The amendments serve to emphasise that: The Authority must be satisfied that it is necessary for the child to be placed with the Connected Person before the Connected Person's suitability to be a foster carer has been assessed in accordance with the Regulations. These provisions are to be used only in exceptional circumstances and where there are clearly defined reasons why a full foster carer assessment cannot be undertaken before a placement is made. There is a risk that if a child is placed before the full approval of the carer as a local authority foster carer they may not be approved at the end of the process resulting in a further move for the child. In Section 3, Approval of Immediate Placements of Looked After Children with Connected Persons, it is noted that: A Connected Person approved under these regulations will be entitled to the same support and services including fees, allocation of social worker and allowances as a foster carer.
Advocacy and Independent Visitors The chapter has been significantly amended and expanded in order to reflect The Children Act 1989 guidance and regulations Volume 2: care planning, placement and case review. It should be read in its entirety.

Young Carers

The Regulations that currently relate to young carers are contained within the Young Carers (Needs Assessments) Regulations 2015 and came into force on 1st April 2015.

Under the Children and Families Act 2014 the definition of young carer is a person under 18 who provides or intends to provide care for another person. The concept of care includes practical or emotional support, and 'another person' means anyone within the same family, be they adult or child.

This definition allows more children than under previous legislation to qualify as young carers and be entitled to a needs assessment.

This definition still excludes children providing care as part of contracted work or as voluntary work.

Adoption Panel The two main changes are that when considering adoption not all cases must be referred to the Adoption Panel. Cases where the criteria apply for the local authority to apply for a Placement Order, i.e. the child is the subject of a Care Order or the Threshold Criteria for a Care Order are satisfied or where there is no parent or guardian, will not be referred to the Adoption Panel for a recommendation, but will be referred directly to the Agency Decision Maker for a decision. Also, in terms of the Adoption Panel membership a Central List needs to be maintained containing a list of persons considered to be suitable to be members of an Adoption Panel. This List must be maintained by an appointed senior social worker with at least 5 years' relevant post-qualification experience and relevant management experience.
Placement for Adoption Amendments, mostly relating to detail, have been added throughout the chapter and it is recommended that it is read in its entirety.
Adoption Support A new Section 9.8, Remuneration for former foster parents has been added explaining the remuneration that can, in exceptional circumstances, be paid to former foster carers who become adoptive parents. A link to Adoption Statutory guidance 2013 has also been added.
Adoption Reviews A minor amendment has been made to Section 5, The Conduct of Adoption Reviews (1.d) clarifying parental responsibility for the child.
Applications for Special Guardianship Orders There have been updates throughout the chapter. Ceasing to Look After a Child This chapter reflects the statutory guidance 'Ceasing to look after a child' in 'Care Planning, Placement and Case Review Regulations (2015)' as amended by the 'Care Planning and Fostering (Miscellaneous Amendments) Regulations 2015' together with Working Together to Safeguard Children. The Local Authority has a duty to ensure that when children have been Accommodated under Section 20 (Children Act 1989) and are discharged from, or leave care, that the discharge is in their best interests and that they will be safeguarded and their welfare will be promoted. Where a child has been Accommodated for 20 days or more, the decision should be made by a Nominated Officer, or Director of Children's Services if the child/young person is 16/17 yrs and has been Accommodated under Section 20, before discharge.
Fostering for Adoption, Concurrent Planning and Temporary Approval as Foster Carers of Approved Prospective Adopters This procedure deals with placement of a child with carers who are dually approved, i.e. approved both as prospective adopters and as local authority foster carers. The advantage of this type of placement is that the child will be placed with foster carers who, subject to a Placement Order being made, or parental consent, are expected to go on to become the child's adoptive family. The child therefore benefits from an early placement with their eventual permanent carers. Delay in finding a permanent family for young children who have already experienced neglect early on in their lives may have a profoundly damaging effect on their development. This type of placement has potential to reduce this delay and the damage caused significantly.
Intermediary Services - Dorset Currently Offers a Limited Service On 30 December 2005, legislation came into force assisting persons adopted before that date to obtain information about their adoption and to facilitate contact between them and their birth relatives. With effect from 31 October 2014, further legislation extended this to persons having a Prescribed Relationship with an adopted person. This will include all relatives of adopted adults, from children and grandchildren to civil partners and adoptive relatives. Intermediary agencies may accept applications from a person with a Prescribed Relationship to an adopted person for assistance in contacting a relative of an adopted person and vice versa. This allows, for example, descendants to obtain information about family medical history in relation to inherited diseases.

Placements with Parents

The judgement: Re DE (A Child) [2014] has been added in Section 1.7, The High Court stated that not less than fourteen days notice of a removal of the child should be given to the parents, save in an emergency.

The Court further stated that any removal of a child in circumstances where the child's welfare does not require immediate removal, or without proper consideration and consultation, is likely to be an unlawful interference with the rights of the parent and child under Article 8 of the European Convention on Human Rights.

Whistleblowing Policy and Anti Fraud Strategy

The Whistleblowing Policy and Procedure describes the Council's commitment to supporting and protecting whistleblowers, the steps that you should take if you wish to blow the whistle on serious wrong-doing in the workplace (known as making a "protected disclosure") and how the Council will respond. It is also important for potential whistleblowers to understand that their employment will be protected by the Council on the strict assumption that any disclosures or allegations are not malicious in nature.

This procedure complies with the Public Interest Disclosure Act 1998 and the Enterprise and Regulatory Reform Act 2013.
Care and Supervision Proceedings and the Public Law Outline

Under the Public Law Outline (2014) and the Children and Families Act 2014, there is a 26-week time limit for the completion of care and supervision proceedings. This places an increased emphasis on pre-proceedings work and the quality of Assessments.

Where adoption is the permanence plan for the child and no Care Order has been made, combined care and Placement Order applications should be made, so that decisions can be made swiftly. Where there are on-going Care Proceedings, the Placement Order application should be submitted as soon as the Agency Decision Maker decision has been made. The court may make both orders, which would ensure that the child remains protected should the Placement Order be revoked (as the Care Order would automatically be reactivated).

Placement Order applications are not subject to the 26 week time limit, but an early application will ensure best use of court time and help keep to a minimum the overall length of the process. The application must clearly state why the parents cannot parent the child, what other realistic permanence options have been considered and rejected, and why adoption is the only permanence option that meets the needs of the child.
Young Persons Protocol The previous Dorset chapter has been removed and replaced and the new chapter will need to be read in its entirety.
Unaccompanied Asylum Seeking Children The previous chapter has been removed and replaced by a link to the Statutory guidance for Local Authorities on the Care of Unaccompanied Asylum Seeking and Trafficked Children (2014).
Dorset Scheme of Nomination and Delegated Authority for Children's Services This new chapter clarifies decision makers and holders of responsibility throughout the department and should be consulted before any significant decision is made regarding children in need or in care. The current chapter is Under Review but remains relevant until such time as it is updated or replaced.
