Children With a Child Protection Plan Moving to Another Local Authority Area

NOTE: Luton follows the Luton, Bedford Borough and Central Bedfordshire Child Protection Procedures – ‘Children who Move Across Local Authority Boundaries’.

Please follow this guidance as soon as a child with a Child Protection Plan goes to stay in another area, even on a temporary basis, to ensure the local authority has a record of all children with Child Protection Plans in their area.

If a child has moved to live in another area then please also contact the Safeguarding and Quality Assurance Manager to request a ‘Transfer Out’ Child Protection Conference with the other local authority.

A transfer cannot be agreed if:

  • They do not have a fixed address in the other local authority (i.e. they are homeless or ‘sofa-surfing’);
  • Luton continues to be responsible for their accommodation in the other local authority;
  • Their permanent address remains in Luton;
  • There is a plan for them to return to a permanent address in this local authority;
  • They are a Luton looked after child;
  • We are in PLO or legal proceedings;
  • We have an ongoing legal responsibility for the child (e.g. Supervision Order).

A transfer will be progressed when:

  • The Case-Holding Manager (Team Manager) confirms with the Designated Manager (Safeguarding and Quality Assurance Manager) that the request meets the criteria;
  • All the documents listed on Page 2 are completed and are either available in the child’s LCS record, or are sent separately to the Safeguarding Business Manager (please specify which).

Once all the information is received the Safeguarding Business Manager will contact the other local authority to arrange a date for a transfer Child Protection Conference within 15 working days of receipt of the information.

The Case-Holding Team (Neighbourhood Team or Children with Disabilities Team) will retain case responsibility until the Transfer Child Protection Conference. Any request for services or interim support from the other local authority should be made to the relevant MASH by the case holding team.

*Please note that the receiving LA has the right to cancel the receiving-in Child Protection Conference if they do not receive an up-to-date Social Worker’s Report no later than 2 days before the CPC.

Information Required For Transferring Responsibility For a Child With A Child Protection Plan To Another Local Authority

A Transfer Summary, containing the following information:

  • Full details of the child – name, DOB, current address and planned Luton address gender, ethnicity;
  • Details of any siblings – names, DOB, current address and planned Luton address, gender, ethnicity;
  • Details of parents and/or carers – names, DOB, current address and planned Luton address, gender, ethnicity;
  • Date of Initial Child Protection Conference, category of plan;
  • Reason for the Child Protection Plan;
  • Category of abuse/neglect;
  • Length of time the child has been the subject of a plan;
  • Overview of the historical involvement with the child and their family, including any history of previous sibling adoptions or previous periods of being a Looked After Child;
  • Assessment and intervention work undertaken;
  • Legal status or any legal issues (including PLO etc.);
  • Dates child was last seen/statutory visits;
  • The organisations contributing to the plan;
  • The planned outcomes for the child;
  • Tenancy arrangements.

Additional Documents:

  • Up-to-date chronology;
  • Most recent Assessment including genogram/family composition;
  • Current Child Protection Plan;
  • Minutes of the Initial Child Protection Conference;
  • Minutes of Child Protection Review Conferences held in the period of this Plan;
  • Minutes of the most recent Core Group meeting;
  • Other relevant assessments or information;
  • List of professionals to invite to the Child Protection Conference (with contact details).

5 Working Days before Child Protection Conference:

  • Up-to-date Pre-Meeting CP Report to be sent to Safeguarding Business Support Manager.
